Terms of Service

These Terms of Service (“Terms”) govern your use of the website www.samsfsd.com and the Sam's Fried Chicken & Burger mobile application (the “Service”), operated by Sam's Fried Chicken and Burgers (“Sam's”, “we”, “us”). By placing an order or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Sam's offers cooked-to-order fried chicken, burgers, and related items for delivery in Faisalabad, Pakistan. The Service lets you browse the menu, place orders, pay on delivery, and track the status of your order.

2. Your Account

  • To place an order you may need to create an account by providing your name, email address, and phone number.
  • You are responsible for keeping your password confidential and for activity on your account.
  • You must provide accurate, current, and complete information. Orders with incorrect contact or delivery details may be cancelled.
  • You must be at least 13 years old to create an account. Minors should use the Service with the involvement of a parent or guardian.

3. Orders and Acceptance

  • Placing an order is an offer to buy. Your order is only confirmed once we accept it, which we show by changing the order status to “Confirmed”.
  • We may refuse, limit, or cancel an order in our discretion — for example, if an item is out of stock, the delivery address is outside our service area, the order appears fraudulent, or we cannot reach you to confirm details. If we cancel your order before delivery, you owe nothing.
  • We accept orders during our operating hours, which are posted on the Service. Orders placed outside operating hours will be queued until we reopen.

4. Prices and Payment

  • All prices are in Pakistani Rupees (PKR) and include any applicable taxes.
  • Prices may change without notice. The price shown at the time you place an order is the price you pay for that order.
  • Payment is by Cash on Delivery (COD). You agree to pay the full amount in cash to the delivery rider on receipt of your order.
  • A delivery fee may be added to the order total. The delivery fee is shown on the cart page before you place the order.

5. Delivery

  • We deliver within Faisalabad. We may decline orders to addresses outside our service area.
  • Estimated delivery times are typically 30–50 minutes but are not guaranteed. Delivery times depend on order volume, traffic, weather, and other factors outside our control.
  • Please be available at the delivery address with the cash payment ready. If we cannot reach you or no one is available to receive the order, the order may be cancelled and we may decline future orders to that address.

6. Cancellations

  • You can request to cancel an order before we mark it as “Confirmed” by calling us at 0325 4155528.
  • Once an order is being prepared we generally cannot cancel it because the food is cooked to order.
  • We may cancel an order in the situations listed in section 3. If your order has already been delivered there is nothing to cancel; refund situations are covered by our Refund Policy.

7. Food Quality and Allergens

We take care in preparing your food, but our kitchen handles multiple ingredients including wheat, dairy, eggs, soy, and various spices. We cannot guarantee that any item is free from a particular allergen. If you have a serious allergy, please contact us before ordering. By placing an order you accept this risk.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in any way that damages, disables, or impairs the Service.
  • Place fraudulent orders or use a payment method you are not authorised to use.
  • Attempt to access the Service's admin areas, other users' accounts, or our systems without permission.
  • Scrape, copy, or republish content from the Service except as permitted by law.
  • Abuse, threaten, or harass our staff, riders, or other customers.

We may suspend or close accounts that breach these rules.

9. Intellectual Property

The Sam's name, logo, menu items, photographs, recipes, website design, and all related materials are owned by Sam's and are protected by intellectual-property laws. You may not copy, reproduce, or use them without our written permission, except for personal, non-commercial purposes such as viewing the menu or placing an order.

10. Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, Sam's makes no warranties (express or implied) about the Service, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the extent permitted by law, Sam's is not liable for any indirect, incidental, special, or consequential losses arising from your use of the Service. Our total liability for any claim relating to a single order will not exceed the amount you paid for that order.

11. Indemnification

You agree to indemnify and hold harmless Sam's, its owners, employees, and agents from any claims or damages arising out of your breach of these Terms or your misuse of the Service.

12. Governing Law and Disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Faisalabad, Pakistan.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of the Service after a change means you accept the updated Terms.
